Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the Zolare website and your purchase of any Zolare products. By accessing our website or placing an order, you agree to be bound by these Terms.

Zolare Pty Ltd (ABN 73 692 949 974) ("Zolare", "we", "us", "our") reserves the right to update these Terms at any time. The version in effect at the time of your order will apply to that order.

Eligibility

You must be at least 18 years of age and capable of forming a binding contract under Australian law to purchase from us. By placing an order, you confirm that you meet these requirements.

Products and orders

Product information: We take care to ensure product descriptions, specifications, and images on our website are accurate. However, slight variations in colour, finish, or dimensions may occur due to display settings, manufacturing tolerances, or material characteristics. These variations do not constitute a defect.

Certification claims: Our eyewear is independently tested to AS/NZS 1337.1:2010+A1:2012+A2:2018, Clause 3.3.1 (Medium Impact Resistance). Test reports are available on request. Certification claims relate to the tested configuration only and do not extend beyond the scope of the testing performed.

Order acceptance: Submission of an order constitutes an offer to purchase. We reserve the right to accept or reject any order at our discretion. A contract is formed only when we issue an order confirmation email. We may decline orders for reasons including product unavailability, pricing errors, suspected fraud, or shipping restrictions.

Pricing and payment:

  • All prices are in Australian dollars (AUD) and include GST where applicable.
  • Prices may change without notice. The price applicable to your order is the price displayed at the time of order submission.
  • Payment is required in full at the time of order via the methods offered at checkout.
  • In the event of an obvious pricing error, we reserve the right to cancel the order and refund any payment received.

Shipping and delivery

Estimated dispatch and delivery times are provided as a guide only and are not guaranteed. We are not liable for delays caused by couriers, customs, weather, or other circumstances outside our control.

Risk of loss or damage to the products passes to you upon delivery to the address you provided. You are responsible for ensuring the delivery address is correct and that someone is available to receive the package.

International shipping, where offered, may attract import duties, taxes, and customs fees payable by you on receipt.

Returns, exchanges, and refunds

Returns and refunds are governed by our separate Returns Policy, which forms part of these Terms. The Returns Policy does not exclude or limit any rights you have under the Australian Consumer Law.

Warranty

Our products are covered by the Zolare Warranty, in addition to the consumer guarantees provided under the Australian Consumer Law. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Intellectual property

All content on our website — including text, images, logos, the ZOLARE name, the ARDEN frame name, photography, design, and code — is owned by or licensed to Zolare and protected by Australian and international intellectual property laws.

You may view and download content for personal, non-commercial use only. Any other use — including reproduction, distribution, modification, or commercial exploitation — requires our prior written consent.

Acceptable use

You agree not to use our website to:

  • Engage in fraudulent, unlawful, or harmful activity.
  • Interfere with the website's operation, security, or other users' access.
  • Scrape, copy, or harvest content for commercial purposes without consent.
  • Submit false, misleading, or defamatory content.

Limitation of liability

Nothing in these Terms excludes, restricts, or modifies any consumer rights or guarantees you have under the Australian Consumer Law that cannot lawfully be excluded.

To the extent permitted by law, our liability for any claim arising from your use of our website or purchase of our products is limited, at our option, to:

  • Replacement of the product;
  • Repair of the product; or
  • Refund of the purchase price.

We are not liable for any indirect, incidental, consequential, or special losses, including loss of profit, business, or data.

Termination

We may suspend or terminate your access to our website at any time without notice if you breach these Terms or engage in conduct we reasonably consider harmful to our business, customers, or reputation.

Governing law

These Terms are governed by the laws of Queensland, Australia. Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the courts of Queensland.
